Healthcare Ethics Paper Brian Lucas HSC / 545 Healthcare Law and Ethics 1/16/2012 SHAWNA BUTLER Healthcare Ethics Paper My paper is on patient dumping which happens when a medical treatment facility may treat a patient initally for acute symptoms but then realizes the patient has no means to pay for the medical services rendered. In some cases back in the 1990's it was found that a patient was put into a cab and the cab driver paid to take the patient away and let out on a street corner somewhere in a city in the USA. Some stories have been told that patients only had on a hospital gown and diaper and dumped on the curb. Usually these patients are older population, may have dementia or are chronic alcoholics and are too sick to care for themselves. Of course this practice is illegal after Congress passed the â€Å"Emergency Medical Treatment and Active Labor Act (EMTALA), sometimes referred to as COBRA since it was part of the year’s Consolidated Omnibus Budget†. (http://www. nurseweek. com, Karen Markus, JD, RN, p 1. ) The Emergency Medical Treatment and Active Labor Act is a law passed by Congress to protect the patients from the practice of patient dumping. The law states that every patient that seeks medical treatment care in medical treatment facility must be assessed or screened by a qualified medical professional for the presence of an emergency medical condition. The law also requires the medical tratment facility to run tests, to rule out an emergency medical condition, can be screened by a physcian, nurse practicioner, physcian assistant. The patient must not just be triaged, which is a process in which order of priority a patient is to be screened and treated, but must be assessed to whether the patient has any health or safety issue that will result in impairment of life or death. The law states that the patient must be stabilized before any kind of means to transfer may occur. Supporting documentation both from the physcian or medical doctor, nurse practioner, physcian assistant and nursing care staff must also accompany the patient prior to any transfer. The patient must be deemed stable with no health or life threatening condition occuring during transfer. ((http://www. nurseweek. com, Karen Markus, JD, RN, p 1. ) So why did hospitals and medical treatment facilities start the illegal practice of patient dumping? Hospitals were being burdened with the financial costs of treating patients who were uninsured or didn't have a means to pay for services rendered. Other factors were also researched and was just more than having financial means to pay. Social groups such as poor blacks and hispanic groups were also profiled to have the inability to pay for services rendered. Motivating factors for incentives to patient dump include â€Å"increasing number of uninsured, healthcare cost containment measures, the common law no-duty rule, and ineffective state statutory responses†. Healthcare Ethics Paper Cost cutting measures though is the primary reason for patient dumping and with the common law no -duty rule, both hospitals and physcians have used this measure to decrease liability in servies rendered without the possibility of reemburishment. But in order to protect the patient from denial of care, it is required by law for hospitals and treatment facilities to be compliant within Emergency Medical Treatment and Active Labor Act Law. The patient must be determined to be medically stable before any kind of transfer is to be arranged. So how do the four major eithical principles apply to patient dumping? To answer this we need to look closer at the four major ethical principles and expand on each principle as it applies to our ethical problem. The four major ethical principles are: Autonomy – respecting self-determination of individuals and protecting those persons with diminished autonomy. 2. Benefice – giving highest priority to the welfare of persons and maximizing benefits to their health. 3. Non-maleficence – avoiding and preventing harm to persons or, at least, minimizing harm. . Justice – treating persons with fairness and equity and distributing benefits and burdens of health care as fairly as possible in society. With Autonomy being the first ethical prinicpal, the patient either must be able to understand and make decisions based on the information presented by the hospital for his or her own medical care. If the patient is not in a mental state to do that, then it must be det ermined either through a desginated assigned guardian legally, or through the state to determine the best interest for that patient. With Benefice, the law requires that the patient should be able to have diginity with respect to their own healthcare. They shouldn't be denied medical care based on their race, color, social economic group status and receive a fair treatment as other citizens receive within the laws established by the government. With Non-maleficence, safety is the number one priority here. The patient must be protected from being harmed or harming themselves or others during their medical treatment and care. With Justice, the patient must be treated in a fair and appropiate manner that is equal to the treatments of what other people in society would expect to receive. This would be equal and fair humane treatment. Healthcare Ethics Paper Still even today patient dumping is still happening. Illegal undocumented aliens who are in a condition of chronicle illness or injury are being shipped back to their home countries through the use of air ambulances. When they return to their home countries, it is known that those countires don't have the means or medical equipment to treat those patients and their mortality rate significantly increases. So is this practice an ethical issue. Yes because the avoidance of treating them is still the same issue as before by using the practice of patient dumping. This last year the President of the United States and Congress passed the Patient Protection and Affordability Act. This law still leaves out undocument illegal aliens not allowing them to receive medical treatment. The law is still continuing to evol and it is in the future that changes in the law will be changed to include medical care for these people. It is the hope in the future that all patients regardless of economic social status, race and ethinic groups will receive fair and adequate humane medical treatments. Functional Area #3 – Learning Environment: In order to use relationships, the physical space, materials, daily schedule, and routines to create a secure, interesting, and enjoyable environment that promotes engagement, play exploration, and learning of all children including children with disabilities and special needs, I do the following: †¢I have made sure that all Centers are laid out to help Children better benefit in learning. By putting the quite, busy messy centers together. †¢We also have an ABC carpet that’s just for group time. Limit 10 to 15mins †¢I have put out many different learning activities for each center. Reading has lots of books, writing has name cards letter strips, Dramatic Play table toys has theme related items. Blocks have cars, animals, dollhouse furniture. Science has Theme related items Art I put out different things weekly to keep the Creativity going. †¢Also during the day we have group time twice, free time, small groups twice, outdoor play twice when weather permits nap.

A League Of Nations

A League Of Nations The First World War (1914-1918) caused horrible slaughter and destruction in the countries of Europe and Asia. It produced a horror of war and created an idea to set up an international organization which would prevent the outbreaks of wars in the future. As a result of such ideas, and as a result of such discussion in the Peace Conference in Paris, in 1919, an agreement was reached by the victorious governments to set up an international body to be called the League of Nations. An agreement was entered into for this purpose. It was called the covenant of League of Nations. The covenant described the purposes, the constitution and functions of the League of Nations. On January 10, 1920, the League of Nations was formally established, with Geneva, in Switzerland, as its headquarters. History of League of Nations: The league did not live long. After a period of nearly 20 years, it ceased to exist, when the Second World War broke out. The membership of the League of Nations varied from time to time. At first it consisted of 42 member states, for example, England, France, Japan and other. Germany was excluded because she started the war. Russia was not allowed to join it, because it did not serve her isolationist policy. After the failure of the league to check Italian and Japanese aggressions and conquests in 1935 and in 1937, it was practically dead. The outbreak of the World War two put an end to the existence of the league. Aims of the League: The covenant of the league declared that the aims or purposes of the league were three: namely To preserve peace in the world To settle international disputes by peaceful methods and not by war To promote cooperation among the peoples and nations of the world, so as to increase welfare and prosperity of these nations. League Structure: The machinery of the league consisted of an assembly, a council, and a secretariat. Before World War II (1939-1945), the assembly convened regularly at Geneva in September; it was composed of three representatives for every member state, each state having one vote. The council met at least three times each year to consider political disputes and reduction of armaments; it was composed of several permanent members, France, Britain, Italy, Japan, and later Germany and the Union of Soviet Socialist Republics (USSR) and several nonpermanent members elected by the assembly. The decisions of the council had to be unanimous. The secretariat was the administrative branch of the league and consisted of a secretary general and a staff of 500 people. Several other bodies were allied with the league, such as the Permanent Court of International Justice, called the World Court, and the International Labor Organization. This international alliance, formed after World War II, not only profited by the mistakes of the League of Nations but borrowed much of the organizational machinery of the league. The Rise of League of Nation When League of Nations came into being, it did so much work and rose day by day. Some of its achievements by rising are as following: Settlement of Disputes: The League quickly proved its value by settling the Swedish-Finnish dispute over the Ã…land Islands (1920-21), guaranteeing the security of Albania (1921), rescuing Austria from economic disaster, settling the division of Upper Silesia (1922), and preventing the outbreak of war in the Balkans between Greece and Bulgaria (1925). In addition, the League extended considerable aid to refugees; it helped to suppress white slave and opium traffic; it did pioneering work in surveys of health; it extended financial aid to needy states; and it furthered international cooperation in labor relations and many other fields. Try to prevent the outbreak of another war: The league tried to prevent the outbreak, by outlawing war as an instrument of national policy of the sovereign state. An agreement not to resort to war by all great powers of the world was entered into, called the Locarno pact. Social and Humanitarian Achievemnt: The league of nations had several social and humanitarian achievements to its credit. Its health committee endeavored to fight against such cruel diseases all over the world, as malaria, cancer, syphilis, T.B and others. Further, the league had also controlled the trade and sale of such injurious things as opium. The Geneva agreement of 1925 proved that the retail, sale, import and distribution of opism shall be the monopoly of the states. Another committee of the league, called the permanent committee on arts and letters, performed two services, namely, it conserved the masterpieces of arts and letters and promoted intellectual cooperation. The league dealt with the important questions of labor and of the relations between the workers and employers. These functions were performed by the international labor organization (I.L.O). It is one of the bodies which has survived the league. Membership: The League grew in its membership, from 42 in 1920 to over 60 by 1929. More countries were showing commitment to the principle of peace-keeping. Peace-keeping Successes: During the first ten years of its existence, the league had several achievements to its credit. It settled several international disputes between states and nations and thus prevented the outbreak of war between them. During its twenty years of existence, the league settled thirteen political disputes. Among them the first important dispute was a quarrel between Italy and Greece over the island of Corfu in 1923. The quarrel was amicably settled by the intervention of the league. The second serious dispute was between Greece and Bulgaria over their boundaries in 1924. Both countries were about to fight but the dispute settled by the league peacefully. Improved Relations with Germany: League increasingly seen as a peace-keeping organization rather than a winners club, Germany was allowed to join the League in 1926. Fall OF LEAGUE OF NATIONS The success of League of Nations can be judge on the basis of its handling disputes and international conflicts incidents. The authenticity of any organization can be checked by its utility of solving political and social issues. During 1920s League provided a useful but modest addition to international diplomacy where round of negotiations and diplomatic relations develop. Stress was made on sitting together of nations for the settlement of disputes. Security was provided to frontiers and problems of Disarmaments were solved. but unfortunately League was helping and solving matters of minor states because of influence of BIG POWERS on world League failed to implement its will on them which gave a true picture of its contradiction of covenant. League failed in its main object of maintaining peace in the world. In spite of its efforts for two decades , the whole world was involved in a war in 1939. By that time, the machinery of the League Of Nations had completely broken down. The failure of League Of Nations can be attributed to many causes. They are: 1. Absence Of Great Powers : It was unfortunate that the covenant of the League of Nations was made a part parcel of the peace settlement. It would have been better if it had kept separate. There were many states which consider the Treaty Of Versailles as a treaty of revenge, and were not prepared to ratify the same. By not ratifying the treaty, they refused to be the members of the League. The absence of the great powers from the international organization weakened her and was partly responsible for its ultimate failure. Japan, Germany and Italy also left the League and their defection must have weakened the League. 2. Domination Of France and England: It was felt that the League Of Nations was dominated by England and France and consequently the other states began to lose their confidence in that organization. 3. Rise of Dictatorship: The rise of dictatorship in Italy, Japan and Germany also weakened the chances of success of the League of Nations. Japan was determined to acquire fresh territories and her unscrupulous patriotism threw to the winds of all principles of international law and morality. If the League was prepared to condone her fault of conquering Manchuria. She was prepared to give up her membership of the League and that is exactly what she actually did. When the League of Nations decided to take action against Italy on account for her aggression in Abyssinia, Italy left the league. In the wake up spreading dictatorship states continued to be the members of the League so long as their national interest were not in any way endangered and sacrificed. 4. Limitations of Legal Methods: The League Of Nations demonstrated the limitations of the legal methods. The League was fairly efficient in structure and probably would have worked if there had existed a realization of a community of interest. Law grows out of public opinion cannot operate in disjunction with it. In the case of League law proposed and opinion disposed. According to Lincoln: Public sentiment is everything. With public sentiment nothing can be fail ; without it nothing can be succeed. 5. Loss of Faith In League: Small nations lost their faith in the effectiveness of The League to save them from any aggression. The principle of collective security was not applied in actual practice. Each state decided to follow her own policy, the principle of security weakened and thus there was nothing to check the aggressive policy of Hitler. 6. Constitutional Defect: The League of Nations failed because of certain constitutional defects. In the cases of disputes brought before the council of the League under Article 11, decisions of the council had to be unanimous in order to adjudge a nation guilty of having violated the covenant by resort to war or unjustifiable aggression, In Article 15. If the decisions were not unanimous verdict under Article 11, the disputing parties were free to resume the hostilities after a period of 3 months. By allowing exceptions, the covenant seemed to assume that was remained the normal solution of international disputes. 7. Narrow Nationalism: Narrow nationalism was still the dominant among the peoples of the world. France was increasingly concerned with her national security, while Great Britain considered that problem less urgent than promoting commerce by fostering international trade. Japan intoxicated by her emergence as a world power, while Italy was desperate to redress her damage. Germany was indulged to retain her national prestige even at the cost of an aggressive military adventure. 8. Lack Of Mutual Co-Operation: The member of the league lack mutual co-operation which is always essential for the success of an organization. For France the League was an instrument for providing her security from Germany. On the other hand Great Britain wanted League protecting her imperialist interest. Hitler found League a great hurdle on the way of rise of Germany. 9. Separate Lines of Thoughts: The League was the offspring of a marriage of two separate lines of thoughts. In one of these which were developed my Mr. Taft and others in the U.S. The stress was on organized forces. There has to be League of enforced peace On the other hand the British attitude was extremely hesitant in its approach to the nation as enforced peace. If the fourteen points of Woodrow Wilson are consulted we find that a general association of nation is projected for the purpose of affording mutual guarantees of political independence and territorial integrity In its proposal the world peace is not mentioned and international co-operation is restricted to one limited object. These two inconsistent principles were incorporated in the fabric of the League itself and no wonder it failed. 10. The Depression undermined the League: The League was weakened by the Great Depression that swept the world after 1929. At a time of economic crisis governments were less interested in what happened in faraway places. Japan and Italy were able to invade other countries without being punished effectively by the League. 11. Manchurian Crisis: On the night of Sep. 18-19, 1931 some Japanese soldiers making an attempt to blow off the railway line near Mukdan. Japan took full advantage of this minor incident and on the 18th Sep, 1931 she invaded Manchuria and also occupied all Japanese cities north of Mukdan. League of Nations failed to implement sanctions on Japan and on March 27, 1933 Japan decided to withdraw her membership of League of Nation. CONCLUSION: According to most of the thinkers , existence of League Of Nations was at wrong time .Then , all the nations was indulge in the concept of narrow nationalism and sovereignty. Situation would have been much more different had except the concept of Internationalism. It is wrong to believe League Of Nations done nothing, it paved the way of United Nations Organizations.

Critique of Communism in Animal Farm by George Orwell Essay -- Animal

Karl Marx’s perfect society described in his Communist Manifesto is in direct conflict with the implementation of Soviet Communism, which was scathingly criticized by George Orwell’s book Animal Farm. Karl Marx believed that in order to form a just and equal society, the working class, called the proletariat, would have to overthrow those who owned the means of production, who were known as the bourgeoisie. This was to be known as the Proletariat Revolution where the oppressed laborers in capitalist societies, such as England, would unite under a common cause to overthrow the oppressive bourgeoisie, and establish a communist society. This would be a society where all were equal, each performing to his ability, and each receiving according to his needs. A dictatorship would be necessary at first to get the ball rolling, but would eventually voluntarily give up power, as it would no longer be needed. However, this was never destined to be. The rise of the Soviet Union was a testament to this, brilliantly depicted and condemned by George Orwell. Marx ended the Communist Manifesto with the fighting words â€Å"WORKING MEN OF ALL COUNTRIES, UNITE!† (Marxism, 44). This was to be the inspiration for the proletariat to band together and realize that they were being oppressed by the bourgeoisie. After they realize this, they would rebel, in which a revolution would take place where the proletariat would be victorious over the bourgeoisie. Old Major, the eldest pig in Animal Farm was the animal recreation of Karl Marx. He professed, â€Å"Whatever goes upon two legs is an enemy. Whatever goes upon four legs, or has wings, is a friend† (Orwell, 31). In this case, man is the bourgeoisie and the animals are the proletariat. Both Karl Marx and Old Maj... ...re breaking every rule that they themselves had put forth in accordance with Old Major’s revolutionary vision. Animal Farm was a mirror image of communism gone awry in the Soviet Union. It also shows Marx’s naivety of the fact that there will always be the clever that take advantage of the ignorant. By keeping the population ignorant, the clever gain even more power, which is was happened in the Soviet Union and Animal Farm. The ones that took part in the revolutions would never realize that they were holding the short end of the stick, just as they were in their previous state of affairs. They were cold, miserable, and starving. In their brainwashed state they still believed that the dismal state they were in was better than their situation before the revolution. George Orwell finished his book on a somber note, the state in which Joseph Stalin left the Soviet Union.

The Difference Between Bullying and Harassment :: cyberbulling, code of conduct, schools

Bullying and harassment are two distinct words but have a quite similar meaning as well as effects. These effects result in people becoming overwhelmed and depressed because of the constant abuse whether verbal or physical from another person that does not consider the victim as of any value to this world. Although verbal and physical bullying have been taken care of most of the time, the number one type of bullying that has not yet been addressed and taken care of is cyberbullying. Cyberbullying occurs online but, it is never taken care of by the school board because it is not happening in school and nothing is stated under the code of conduct to get involved with the situation. A code of conduct is a set of rules outlining the responsibilities of, or proper practices for, an individual, party or organization that are to be followed. They are intended to help out an area by laying down ethics and support decisions made by people at the organization or work. A code of conduct exist everywhere whether businesses or schools, it is created to handle problems in a proper way. It is unbelievable to be know that the code of conduct does not state anything about the consequences for bullying and/or harassing an individual. They are not really required to be followed since it is just mostly expected behavior and can be easily broken without consequences. Although schools have a set of rules, they are rarely enforced and some don’t even do anything on when something occurs off campus. Cyber bullying is no different from verbal and physical bullying it has the same effects, it hurts innocent individuals and it should have the same consequences. Cyber bullying the majority of the time, occurs between the ages of 13-18. Most teens feel that by not telling someone that this is happening it will only make it worse, that the bullying will never stop. In the case of Megan Meier who was described by her parents as â€Å" bubbly, goofy†,was an average teenager who was full of life and had goals, that was before she committed suicide because of the effects of cyber bullying. In the Worse Cases of Bullying website it states â€Å" Met a boy, â€Å"Josh Evans†, online through her new Myspace account. Josh introduced himself via an email to her parents and, with their blessings, Megan continued her new friendship and soon became infatuated with him.

Censorship is the act of removing this questionable material. Understandably, it is illegal to yell fire in a crowded room or use children for pornographic purposes, but the power of censors has exceeded logical boundaries. Works of art, such as Huckleberry Finn and Miss Saigon , have felt the full strength of censorship. The main problem regarding censorship is not knowing who has the right to determine what is valuable art and what is smut. Quite often members of religious groups take it upon themselves to determine the value of something. â€Å"The abortion pill should be banned due to the negative consequences it causes to women† ________ Abstract The New Era's freedom of sexuality and contraception's campaigns had reached all the world, leading as a consequence the fact that in every country there are more and more unwanted pregnancies. Conception has been debated for so long, and there's not a scientific posture accepted officially by any nation, so due to desperation, medical experts had created what appeared to be -for some- the solution to unplanned pregnancies, the abortion pill.The components of this pill are lethal if the it doesn't work as it meant to be, psychological and physical effects can remain forever in women's life, without even a possible cure, depending on the cases. The purpose of this essay is to proof that its better to think before making any decision that will bring serious impacts in people's life, including family and of course, society; abortion with the pill its not easier or less painful than the other ways. INTRODUCTIONAbortion had been part of our history from many years ago, but do we really know how it appeared and how it influences negatively our society?. I shall began the development of this controversial subject by exposing the genesis of abortion; the first evidence of induced abortion is from the Egyptian Ebers Papyrus near the 1550 BC, but it was in China were this matter became a concurrent practice between women, so according to Chinese folklore, the Emperor Shennong prescribed mercury to induce abortions.In primitive cultures, they used physical activities as a way to interrupt pregnancy, such as climbing, weightlifting or diving, while others tend to use plants and its poisons or pouring hot water into the abdomen. Some archaeological discoveries indicate that surgical attempts to extract the fetus existed in these cultures. In Greece and Rome, abortion was practiced as well. Hippocrates, a Greek physician forbid the use of pessaries or vagina l suppositories to induce the interruption; apparently because they caused vaginal ulcers, in an oath for doctors.In the other hand, Scribonius Largus, a Roman famous doctor said that â€Å"Hippocrates, who founded our profession, laid the foundation for our discipline by an oath in which it was proscribed not to give a pregnant woman a kind of medicine that expels the embryo or fetus†[1]; the interpretation of this oath was only applied for women who were not prostitutes, because otherwise they would have to use methods such as jumping and touching their buttocks with their heels on each leap.There were found likewise certain objects described as instruments that apparently dilated cervix and curette inside of the uterus. Women got desperate and started using objects such as spoons, sticks, candles and knives to abort.Statistics show that abortion remained dangerous and that 150,000 abortions that occurred annually in the U. The natural abortifacients were the inspiration for the creation of the abortion pill, this included botanical preparations with Italian catnip, cyperus, pennyroyal (which is lethal), savin, opium, lavender and thyme, even animals were used like crushed ants, saliva of camels and hairs of deers and even bear's fat.The abortion pill began in New York during the 1830's by Madame Restell who illicitly provided surgical abortion and the pill. She offered confidence and a good job, she called them â€Å"Female Monthly Regulation Pills†, the labels she used as advertising told about birth control and a possible miscarriage. Her purpose was to help women at first, but hen it became a millionaire business and she took advantage of it, extending her services not only to unmarried women who were pregnant, but also to those who were married and didn't want a baby yet, leading to the pioneer of family limitation of the time.She remained forty years in the market and was always the main target of criticism, she got arrested in 1841 and committed suicide in 1878[4]. The abortion pill's main component is called Mifep ristone, which is a synthetic steroid used as a pharmaceutical. Its both used as a contraceptive and an abortifacient during the first two months of pregnancy. It was discovered by Georges Teutsch, developed in Roussel-Uclaf Co. in 1980 but bettered by Emile Baulieu, who made tests of its use in eleven women in Switzerland at the University of Geneva's Cantonal Hospital, the results ere successful and in 1988 France announced its approval, despite antiabortion movements that took place. French government decided to distribute it free of charge and near 34,000 women used this pill for a short period of time, until Roussel-Uclaf settled a price. Mifepristone was introduced to Great Britain and Sweden in 1991, this is when the Roman Catholic Church protested and blocked all types of distribution of the abortion pill.
